Terms of Service

You must be at least 18 years old and legally able to enter into a contract. If you use the Service on behalf of a company, you confirm you have authority to bind that company to these Terms. The Service is offered from the United States; you are responsible for complying with the laws of your own location.

The Prompt Engineer helps you turn what you are trying to accomplish into structured prompts you can use with third-party AI tools such as ChatGPT. It is a prompt-building tool and educational product only.

We are not affiliated with, endorsed by, or sponsored by OpenAI, Anthropic, Google, or any other AI provider. Access to those tools requires your own account with those providers and is subject to their terms, pricing and availability, which we do not control. We provide no guarantee of any specific AI output, ranking, revenue, traffic, sales, savings or other business result. Nothing in the Service is legal, medical, financial, tax, investment or professional advice.

You must provide accurate information and keep your login credentials confidential. You are responsible for all activity under your account. Accounts are for one individual; sharing, reselling, or distributing your access — including sharing the members-only tool link — is prohibited and may result in immediate termination without refund. Tell us right away at Admin@stucktoselling.org if you suspect unauthorized use.

Membership costs $19 per month in U.S. dollars. By subscribing you authorize us and our payment processor to charge your payment method $19 automatically each month, on a recurring basis, until you cancel. There is no contract or minimum term, and no cancellation fee.

Your subscription renews automatically on the same date each billing cycle. Applicable sales tax or VAT may be added and is calculated and collected at checkout. If a payment fails, we and our processor may retry the charge; if it continues to fail, your access may be suspended or ended. We may change pricing at any time with at least 30 days’ notice by email, and the new price applies to billing cycles after that notice period.

All payments on this site are processed by Stripe, Inc., a certified PCI Service Provider Level 1. Card details are entered directly into Stripe’s secure, encrypted checkout. We never receive, see or store your full card number, CVC, or bank credentials. Your use of checkout is also subject to Stripe’s own terms and privacy policy. Stripe or its partners may act as merchant of record and handle tax collection and remittance on qualifying transactions, and your bank statement may show a descriptor reflecting that.

You may cancel at any time from your account page or the billing portal. Cancellation stops all future charges, and your access continues through the end of the billing period you have already paid for. We do not provide partial or prorated refunds for unused time in a period.

Because the Service delivers digital content and immediate access on purchase, all payments are otherwise final and non-refundable, except where a refund is required by applicable law. If you believe you were charged in error, contact Admin@stucktoselling.org within 30 days and we will review it in good faith. You agree to contact us before filing a chargeback. Filing a fraudulent chargeback after receiving access may result in permanent termination and recovery of costs.

You agree not to: use the Service to create or distribute unlawful, infringing, defamatory, deceptive, harassing, sexually explicit involving minors, or otherwise harmful content; misrepresent AI-generated content in a way that deceives others; scrape, copy, reverse engineer, resell, sublicense, or build a competing product from the Service; share account access or the members-only tool link; attempt to bypass paywalls, rate limits or security controls; or interfere with the operation of the Service. We may suspend or terminate access immediately for any violation.

The Service, including its software, site design, copy, images, blog content and the The Prompt Engineer name and branding, is owned by EProducts Empire and protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own business or personal purposes while your subscription is active. That license ends when your subscription ends.

You keep ownership of the ideas and content you submit and of the prompts produced for you, and you may use those prompts commercially. You are solely responsible for reviewing, verifying and taking responsibility for anything you publish or act on. AI output may be inaccurate, biased, outdated, or similar to output generated for other users, and may not be eligible for copyright protection in some jurisdictions.

The Service links to and relies on third parties, including OpenAI, Stripe, email and hosting providers. We are not responsible for the availability, accuracy, pricing, content, policies or actions of any third party. If a third-party tool changes, becomes unavailable, or terminates your account with them, that is outside our control and does not entitle you to a refund.

Our affiliate program is offered under these Terms and the details published on our affiliates page. By joining, you become an independent contractor — not an employee, partner, agent or joint venturer of EProducts Empire — and you agree to the following.

Commission. You earn 40% of each successful subscription payment made by a customer properly attributed to your referral link, for as long as that subscription remains active and paid.

Attribution. Attribution requires the customer to click your link and subscribe within the tracking window shown on the affiliates page. Tracking depends on the customer’s browser and device. We are not liable for referrals we cannot track, and our records are the final authority on attribution.

Payouts. Commissions are held pending for a 30-day refund and chargeback window. Once payable, they are paid out automatically every Friday through Stripe to the Stripe payout account you connect, provided your payable balance is $25 or more; balances below that threshold roll forward to the following Friday. Payouts require a completed Stripe onboarding and identity verification — commissions accrue but cannot be released until that is finished. Payout timing may shift for bank holidays or if Stripe places a review or hold on an account. You are responsible for the accuracy of your payout details and for all taxes on amounts you receive. U.S. affiliates paid $600 or more in a calendar year must supply a valid W-9 before payout.

Reversals. Commissions tied to refunded, disputed, charged-back or fraudulent payments are reversed, and already-paid amounts may be offset against future payouts.

Conduct. Prohibited activity includes self-referrals or referrals from accounts you control, bidding on our brand terms or close variations in paid search, coupon and cashback sites, spam or unsolicited outreach, fake reviews, cookie stuffing, impersonating EProducts Empire, and making income, earnings or results guarantees. You must clearly disclose your affiliate relationship wherever you promote us, as required by the FTC and applicable law. You are solely liable for your own marketing claims and content and will indemnify us for them.

Termination. We may modify commission rates, tracking windows and program rules prospectively at any time, and may suspend or terminate any affiliate account at our discretion. Fraud or breach of these rules forfeits all unpaid commissions. Any earnings figures shown are illustrative math, not a representation of typical or expected income.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any content or AI output will be accurate, complete, current or suitable for your purposes.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EPRODUCTS EMPIRE AND ITS OWNERS, OFFICERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY OR REPUTATIONAL HARM, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU ACTUALLY PAID US IN THE THREE (3) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You agree to defend, indemnify and hold harmless EProducts Empire and its owners, officers, employees and contractors from any claims, damages, liabilities, losses and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content or prompts, anything you publish or act on, your affiliate promotion activity, your violation of these Terms, or your violation of any law or third-party right.

Before filing any claim, you agree to contact us at Admin@stucktoselling.org and attempt to resolve the dispute informally for at least 30 days.

If that fails, any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. YOU AND WE EACH WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE OR REPRESENTATIVE ACTION. Any claim must be brought within one (1) year after it arises or it is permanently barred.

These Terms are governed by the laws of the United States and of the state in which EProducts Empire is established, without regard to conflict-of-law principles. Where arbitration does not apply, the courts located in that state have exclusive jurisdiction.

You may stop using the Service at any time by cancelling. We may suspend or terminate your access, with or without notice, for violation of these Terms, suspected fraud, chargeback abuse, non-payment, or to comply with law. On termination for cause, no refund is owed. Sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnification and dispute resolution — survive termination.

We may update these Terms. Material changes will be posted here with a new “last updated” date and, where required, sent by email. Continued use of the Service after an update means you accept the revised Terms.

These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. We are not liable for failure or delay caused by events beyond our reasonable control.
